What is Conveyancing?

Conveyancing is required for the successful completion of a property purchase. In simple terms, it is the process of transferring the title of a property from one name to another. Once the process has been completed, the purchaser secures the title to the land of a property and is therefore the legal owner.

Before this can happen, however, a conveyancing solicitor has to run a series of checks to make sure that everything is in order. In conjunction with the land registry, these examine the property, the surrounding land and any issues which the buyer should be aware of before completing the purchase of the property. In England and Wales, conveyancing can be conducted either by a conveyancing solicitor or a licensed conveyancer.

The role of conveyancing solicitors

The conveyancing solicitor's role in a property purchase is to establish that:

• The seller of the property is the legal owner and therefore has the right to sell.
• There are no factors which would impede a mortgage on or re-sale of the property

Usually, conveyancing solicitors are introduced into proceedings when a buyer negotiates an agreed price with the seller. The next step is for the buyer to organise for the conveyancing solicitors to carry out searches and pre-contract enquiries on the property.

When this has been completed, the seller's conveyancing solicitors will prepare a draft contract for the property purchase, which then has to be approved by the buyer's solicitor.

How long does conveyancing take?

The average conveyancing process takes around 10-12 weeks to complete. This, however, is far from an exact science and could take less or more time, dependant on the legal, personal, social and financial situations of both the buyer and the seller.
