Package Travel Claims

When you book your holiday, whether online or via a travel agent’s shop, providing you book your flights and accommodation together in one payment chances are you are buying a package holiday. This means you get extra protection under English Law should things go wrong.

A package holiday must include two of the following three components:

  • Transport
  • Accommodation
  • Other tourist service which compromises a significant proportion of the package


It may be a slip on a broken tile by the hotel poolside, or a traffic accident during your pre-arranged hotel transfer. It may be that an activity you booked went wrong, or your whole family sustained a virus due to poor sanitary conditions.

Providing what happened formed part of the package you paid for then you can usually bring your package holiday claim in the courts back home by alleging that the holiday company did not perform the holiday contract appropriately. If they had done – you would not have been injured!
