Elder Law – Advice on Financial Responsibility and Funding For Long Term Care
EAD Solicitors are highly experienced in dealing with older clients and the issues that come with age. Our will and probate solicitors are well equipped to advise on the planning involved in preserving capital assets should you want or need to prepare for long term residential care or in the event that nursing home care might be required.
EAD offer advice on financial responsibility and funding for Long-term Care, including NHS funded care. Despite advancing years, the majority of people are able to remain in their own homes. However, whether in anticipation of entering a Care Home, or when a move is certain, one needs to look carefully at the issue of funding. Since 1st October 2007 there is now a comprehensive assessment undertaken by both Social Services and the Primary Care Trust (part of the NHS) for the purposes of assessing someone’s care needs.
Depending upon the joint findings, it is feasible to have ones care provided for by the NHS in whole or in part. However, where nursing care is not required, it will be down to the local Social Services department to consider whether you must fund your own care entirely or whether they will provide some assistance.
We are able to assist and advise people at all stages of the assessment process and, in particular, making sure that where NHS or Social Services funding are available that they are properly claimed. The rules surrounding the assessment of need and the assessment of financial resources can be quite complicated and we are very happy to come alongside our clients to help pilot them through the various stages.

Extremely happy with the outcome of my Personal Injury Claim and can only thank Paul McCarthy and his team at EAD Solicitors and also Tim Trotman my barrister arranged by EAD, for all their work and efforts on my behalf. As such I would highly recommend EAD to anyone in need of their service. Once again thanks to all involved.
